But the prospective employer can ask the applicant about convictions,
I'm not so certain about arrests. Then, you have the choice of
revealing your dark past or lying and hoping not to get caught. So
being able to pull NCIC records may not be that much of a change.
They can still quietly not hire you based on your answers or on the
criminal background check that many employers do through non NCIC
records.
Many employers are doing criminal background checks as a routine part
of pre-employment screening. Some check credit records, and that
squicks me more.
I'm not sure about NCIC. I thought it was illegal to use it for other
than official Law Enforcement business. We once attempted to get
access through a police agency, to screen potential Scout Leaders for
child molestation records, but were told that it was felonious for a
LEO to do so. Can you affirm that this is or is not so?
Interestringly, I have a f(r)iend who had the arrest question asked on
a security clearance form, where it is clearly legal. He had been
arrested for Murder. It turned out to be a wrong ID leading to the
arrest, and he got the clearance. My luck would have been
different. Murphy rules.
