We already have a solution that that problem, ready, already part of
federal law in the USA. Small companies like the one you describe
already are exempt from many civil rights laws, or they have relaxed
rules.
Also, the problem usually wouldn't arise in such small companies. In
this debate, we have somewhat lost sight of the actual problem: having
a formal policy that an arrest alone leads to automatic dismissal.
Small businesses such as the one you are talking about often don't
have formal policies, and would actually be far more likely to take
the actual facts into account.
