Ummmmm. The assertion they ave been working on is that companies are
acquiring and using arrest records to make hire and fire decisions. The
methods being used are not clear but negative publicity (ore even
just publicity)
was not being considered in their arguments. Just the policy of discovering
arrest records and making decisions on those records.

Not exactly. That would be the DA acting on behalf of "the
people". If it were
the people we would not need messy things like trial by jury.
