An she too pondered for a moment then raised an interesting point that if some
employer should happen to be using arrest records to discriminate whom they
hire the employer could find themselves in real trouble with the
Federal Government.
As we mentioned earlier in this thread there are certain classes of
people for which
you can not discriminate against. I think it is Title 7 some such
that she mentioned.
She is in HR so has some idea of what companies have to watch for.
In any case if it could be shown that the company was using arrest
records to deny
employment and that it could be shown that members of one of the
protected classes
has a higher chance of being arrested in general than some magic
average, the company
could find itself in much more hot water then they could possibly imagine.
I am sure that there are plenty of actual lawyers here that can look
into this for amusement. :)
